GENERAL TERMS AND CONDITIONS OF BUSINESS

When mountain biking, you're unlikely to be thinking about terms and conditions or safety awareness, and that's precisely why they're so important. By registering for or participating in one of our tours, participants declare that they have read, understood, and fully accept the following rules and guidelines.
As already mentioned in the privacy policy, Schwarzwaldtours.com assumes no responsibility or liability for linked pages and their content.
(1) Contract conclusion and registration
By registering for a mountain bike tour offered by Schwarzwaldtours.com, the participants declared the following:
- Contract fulfillment refers to the services offered and agreed upon.
- Should you (the applicant/customer) register additional participants (e.g., a group), you are liable for the agreed fee for all participants you register, unless a separate agreement has been made. (e.g., one person registers, but the participants each pay individually.)
- Minors must register through their legal representatives.
- Registration automatically results in a contract being concluded.
- The terms and conditions of Schwarzwaldtours.com apply exclusively. No other terms and conditions apply, even if they have not been expressly rejected.
(2) Remuneration
The agreed fee is to be paid directly to the organizer Schwarzwaldtours.com.
Accepted payment methods (as of Dec. 2021): PayPal, GiroPay, Kwitt, bank transfer, cash.
If a service (tour) is booked in advance, the full amount must be paid within 10 days.
Short-notice bookings within a few days can be paid via PayPal or directly to the guide on site.
(3) Conditions for participation
Participants who are not of legal age (under 18) must present a written declaration of consent from a parent or guardian, or be accompanied by an adult.
The tours are offered in a variety of ways, and so are the requirements; however, safe handling of the mountain bike and the necessary fitness for the tours are always required.
Should the guide recognize before or during the tour that the participant is not up to the requirements or is endangering himself or others, the guide is entitled to exclude the participant from the tour at any time.
(4) Safety & Driving Technique Level
Clothing and bike check
A good bicycle helmet, cycling gloves, and a technically sound mountain bike are also required. For safety reasons, participants without a helmet and bike check will not be allowed to participate.
Protective clothing against cold and wet conditions serves to protect the wearer, but is not mandatory equipment.
Driving technique and physical fitness
Personal responsibility and realistic self-assessment should be a given, but for a better assessment of the tours, elevation gain, total distance, and riding technique level according to the STS (Single Trail Scale) are used. http://www.singletrail-skala.deThe difficulty level will be announced before the tour, and it remains the responsibility of the participants to assess their abilities correctly. Under no circumstances should participants allow themselves to be tempted into risky driving maneuvers by the behavior of others.
Insurance
Each participant is responsible for their own insurance coverage. Any costs incurred for rescue, repatriation, medical care, etc., are the responsibility of the participant.
(5) Services
The services offered are detailed in the respective tour descriptions and agreements exchanged via email or messaging services. Any changes to the agreed services or prices must be made in writing.
Tour change
The guide is entitled to change the route during a tour should this be necessary for safety reasons due to unforeseen circumstances such as natural disasters, floods, altered road conditions or other unavoidable circumstances.
Tour cancellation
Except in the case of severe thunderstorms, the tours will take place in all weather conditions. There is no right to a refund of the fee paid.
Pandemic-related regulations (Corona, Covid-19)
If legal regulations prohibit the meeting of participants and guides for the purpose of conducting the tour, the fee will be refunded without question.
(6) resignation
(6.1) by the organizer
If the organizer is unable to conduct the tour for any reason whatsoever, participants will receive a full refund of any payments already made. The organizer is not responsible for any additional expenses incurred by participants through bookings made with third parties.
Should a participant endanger the tour or other participants through their behavior, or create an unhealthy disharmony among the participants, the guide may exclude the participant from the tour. In this case, the guide is not entitled to a refund.
(6.2) by the customer
We want to make things easy for our customers and are very flexible.
If a replacement participant can be found for the booked period, only 10% of the fee will be charged.
Otherwise, the following rule applies.
20% discount starting 30 days before the appointment
50% discount starting 14 days before the appointment
Non-participation results in a 100% penalty.
(7) Termination of contract due to force majeure
Schwarzwaldtours.com reserves the right to offer a maximum of 3 alternative dates in the event of force majeure (excluding pandemics). If this is not possible, the tour price will be refunded.
(8) Rebookings
Schwarzwaldtours.com is flexible and if the date works out, no extra costs will be charged as long as the new date is within 4 weeks.
The participant may also send a substitute at any time, provided that the new participant agrees to the safety guidelines and is suitable for the tour.
